1. Overview

Rapid Reviews ("Company," "we," "us," or "our") provides review generation and reputation management services to businesses ("Clients"). This Privacy Policy explains how we collect, use, and protect information in connection with our services. By using our services or engaging with us as a Client, you agree to the terms of this Privacy Policy.


2. How We Obtain Customer Information

Rapid Reviews does not collect, solicit, or independently obtain personal information from consumers. All phone numbers and contact information used in our SMS-based review request campaigns are provided exclusively by our Clients. These phone numbers belong to individuals who have voluntarily provided their contact information directly to the Client business in the course of an existing business relationship or transaction.

We operate solely as a service provider acting on behalf of our Clients. We do not independently verify the consent status of individual contacts. Our Clients represent and warrant that all phone numbers provided to us have been obtained lawfully and that the individuals associated with those numbers have consented to receive communications.


3. How We Use Contact Information

Contact information provided by our Clients is used solely for the following purposes: sending SMS review request messages on behalf of the Client business, following up on unanswered review requests where applicable, managing opt-out requests and maintaining suppression lists, and improving and operating our review generation platform.

We do not sell, rent, lease, or otherwise share consumer contact information with any third parties for marketing or any other purposes unrelated to delivering our services.


4. Client Responsibility and Consent

Our Clients are solely responsible for ensuring that all contact information provided to Rapid Reviews has been collected with appropriate consent under applicable laws, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and any applicable state laws governing SMS communications.

By submitting contact information to Rapid Reviews for use in a review campaign, each Client certifies that: (a) the individuals listed have provided prior express consent to receive text messages from or on behalf of the Client; (b) the contact information was obtained through a legitimate, lawful business interaction; and (c) the Client will maintain records of such consent and make them available upon request.


5. Opt-Out and Consumer Rights

Every SMS message sent through our platform includes an opt-out mechanism. Consumers may reply STOP at any time to be removed from future communications. Upon receipt of an opt-out request, we will honor the request promptly and add the number to our suppression list to prevent further contact. We will also notify the relevant Client of the opt-out.


6. Data Security

We implement commercially reasonable technical and organizational security measures to protect contact information from unauthorized access, disclosure, alteration, or destruction. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.


7. Data Retention

We retain consumer contact information only for as long as necessary to provide services to our Clients or as required by law. Upon termination of a Client relationship, contact data associated with that Client will be deleted or returned in accordance with our agreement with the Client.


8. Limitation of Liability

RAPID REVIEWS ACTS SOLELY AS A SERVICE PROVIDER AND TECHNOLOGY PLATFORM ON BEHALF OF ITS CLIENTS. WE ARE NOT RESPONSIBLE FOR, AND EXPRESSLY DISCLAIM ALL LIABILITY ARISING FROM: any Client's failure to obtain proper consent from consumers prior to submitting contact information to our platform; any inaccuracies, errors, or unlawful content in contact lists provided by Clients; any claims, damages, fines, or penalties arising from a Client's violation of the TCPA, CAN-SPAM Act, or any other applicable law; any third-party claims related to SMS messages sent on behalf of Clients; and any indirect, incidental, consequential, or punitive damages of any kind.

IN NO EVENT SHALL RAPID REVIEWS' TOTAL LIABILITY TO ANY PARTY EXCEED THE TOTAL FEES PAID BY THE RELEVANT CLIENT TO RAPID REVIEWS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.


9. Indemnification

Each Client agrees to indemnify, defend, and hold harmless Rapid Reviews and its owners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) the Client's use of our services; (b) the Client's breach of any representation, warranty, or obligation under this Privacy Policy or any service agreement; or (c) any claim by a consumer that the Client lacked authorization to send communications to them.


10. Changes to This Policy

We reserve the right to update or modify this Privacy Policy at any time. Changes will be posted on our website at rapidreviews.co with an updated effective date. Continued use of our services following any changes constitutes acceptance of the revised policy.
